Right of Way Claims Agent c.
Position Summary:
Secures and coordinates acquisitions of properties required by the Cooperative for generation and transmission facilities.
Settles damage claims brought against the Cooperative due to maintenance and construction operations.
Promotes and maintains good public relations between property owners and the Cooperative by resolving concerns and complaints involving the rights-of-way and Cooperative owned property.
Tasks, Duties and Responsibilities:
Easement Acquisition
Evaluates the most economical and practical location of easements in connection with member cooperatives’ needs, regional characteristics, surveying, environmental, and engineering design analysis.
Assists the Project Regulatory Section and surveyors with the routing of transmission lines, and the identification of landowners.
Performs title research utilizing both internal and external resources, including investigation of courthouse abstract and title records, tax maps, and field inspections to determine ownership.
Acquires the services of a certified appraiser in accordance with the policy of the Cooperative and provide the necessary easement information for appraisals.
Assists in the negotiation of terms for ROW agreements including the acquisition, relinquishment and modification of easements, and encroachment resolutions.
Stewards all Condemnation activities with outside counsel and provides testimony as needed.
Acquires rights by negotiating the terms and conditions of both non-monetary and monetary easements, deeds, permits, and access agreements to conduct surveys or for construction by contacting landowners, developers, builders, or governmental entities.
Works with Construction Inspectors before and during the construction of the transmission line to prevent and/or resolve right of way issues with landowners.
Performs other duties as assigned.
Fee Title Acquisition of Real Property
Performs tasks in the fee title acquisition of real property for transmission line, substations, pipelines, and generation facilities.
Asset Management, Damage Claims and Miscellaneous Property Issues
Manage BEPC real property and easement assets.
Investigates and resolves claims against the Cooperative as it pertains to property damages caused by construction and/or operational activities either by Cooperative or contracted labor.
Education and Experience Requirements:
Bachelor Degree in a related business, real estate or technical field or Associate’s Degree in a related business, real estate or technical field and two years of experience in utility land acquisition and right of way procurement with knowledge of real estate/land values.
Physical and Environmental Requirements:
Requires working inside in a controlled environment and outside in varying weather conditions.
Requires sitting for extended periods of time.
A large percentage of this time may be riding in a motor vehicle.
Must be able to obtain required driver’s license.
Requires working overtime and traveling at times with short notice.
Requires hearing within normal range, hearing aids are permitted.
Requires vision within normal range, corrective lenses are permitted.
Up to 40% of travel is required per week.
